These terms apply to every sale, install, and service we provide via becoolshop.co.uk. By placing an order you agree to them. If you don’t accept them, don’t place the order. If anything is unclear, call us on 0203 488 1889 before you order.
1. Who we are
Be Cool Shop is operated by Be Cool Refrigeration Ltd (company number 13901261), registered at Office 7, 35/37 Ludgate Hill, London EC4M 7JN. VAT-registered. References to “we”, “us”, or “Be Cool” in these terms mean Be Cool Refrigeration Ltd.
2. The contract
- When you place an order via the site, you are making an offer to buy the goods at the listed price plus VAT plus any installation chosen at checkout.
- We accept your offer when we send the order confirmation email after successful payment. The contract is formed at that point.
- We may refuse an order at our discretion, including (but not limited to) stock unavailability, pricing errors, or where F-Gas verification fails.
- If we discover a clear pricing error (for example, an obviously incorrect decimal), we will contact you before fulfilling and may cancel the order with full refund.
3. Pricing and payment
- All prices are in pounds sterling, shown excluding VAT on the storefront. The 20% UK VAT is added at checkout and shown on your invoice.
- Payment is taken at the point of order via Stripe. We accept all major debit and credit cards.
- Title to the goods passes to you only when we have received cleared payment in full.
- Trade pricing applies only to approved trade accounts. Apply via the “Apply for trade” link in the footer.
4. F-Gas compliance and installation
Air conditioning units and most commercial refrigeration sold on this site contain fluorinated refrigerants. UK law (EU 517/2014, retained) requires installation by an engineer holding a Category 1 F-Gas certificate. At checkout you must choose one of:
- Install with Be Cool, our certified team installs, commissions, and registers the unit. We will contact you to schedule and quote installation separately from the unit price.
- Use your own installer, you must supply your installer’s F-Gas certificate, either by uploading at checkout or emailing it to info@becoolrefrigeration.co.uk before we dispatch. The order is held until we have verified the certificate.
Orders for F-Gas products will not be dispatched without verified F-Gas certification. If verification fails or you don’t supply a certificate within 14 days, we may cancel the order and refund the unit cost.
5. Delivery
Full delivery terms are in our Delivery information page. In summary:
- Free UK mainland delivery on orders over £1,000 ex VAT
- Pallet items typically dispatch within 5 to 10 working days
- Stock parcel items dispatch same week
- Delivery is by third-party couriers; signature may be required for pallet items
6. Risk and ownership
Risk in the goods passes to you on delivery. Title (ownership) passes when we have received payment in full. Until ownership transfers, we may recover any unpaid-for goods.
7. Returns, cancellation and refunds
Full terms are in our Returns and refunds page. In summary:
- Consumer customers have a 14-day right to cancel under the Consumer Contracts Regulations 2013
- Goods must be returned unused, in original packaging, within 14 days of cancellation notice
- A 25% restocking charge applies to bulky / commercial items where they are returned outside the statutory cancellation window (B2B only, consumer rights are not affected)
- Faulty or misdescribed goods qualify for repair, replacement, or refund under the Consumer Rights Act 2015
8. Warranty
- Goods carry the manufacturer’s warranty in the UK (typically 1 to 7 years depending on brand and product). We register your warranty on dispatch where the manufacturer supports it; you should retain your invoice as proof of purchase.
- The manufacturer’s warranty is parts-only unless explicitly stated otherwise. Labour for warranty repairs is chargeable at our standard rates.
- Warranty is invalidated by improper installation, abuse, modification, failure to service the unit per manufacturer recommendations, fire, flood, vandalism, or force majeure events.
- If a warranty claim is approved by the manufacturer, we will refund the part cost and invoice you separately for labour and ancillary charges.
9. Installation service terms
If you select “Install with Be Cool” at checkout, the following additional terms apply in addition to clauses 1-8:
- Installation is quoted separately after the unit order, based on a site survey. We will contact you to schedule.
- Standard installation includes mounting bracket, copper line set up to 5m, and commissioning. Extended pipework, condensate pumps, electrical work, and any building works are not included unless quoted.
- Working hours are Mon-Fri 9am to 5pm. Out-of-hours work is available by agreement at higher rates.
- You must provide site access, working electrical supply, and clear the install area. Obstructed access may incur additional charges.
- We exclude liability for design choices made on your instruction (e.g. undersized units, non-standard locations) where you have been advised in writing of the trade-off.
- A non-refundable installation deposit applies and is set out in the installation quote.
10. B2B vs B2C
Where you are placing an order in the course of business (B2B), some statutory consumer protections do not apply. Specifically, the 14-day cancellation right under the Consumer Contracts Regulations 2013 applies only to consumers, not businesses. Trade buyers are bound by these terms and any separately agreed trade account terms.
11. Liability
- Our total liability under these terms is limited to the price you paid for the goods or services giving rise to the claim.
- We are not liable for: indirect or consequential loss; loss of profits, revenue, or business; loss of goodwill or anticipated savings; loss arising from delay caused by events outside our reasonable control.
- Nothing in these terms limits liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any liability that cannot be limited under English law.
- Where you are a consumer, your statutory rights are not affected by anything in these terms.
12. Force majeure
We are not liable for failure or delay caused by events outside our reasonable control, including industrial action, fire, flood, war, civil unrest, terrorism, government action, transport strikes, power failure, pandemic, or extreme weather. We will notify you promptly and provide an alternative date or cancellation with refund of any unfulfilled portion.
13. Complaints
We aim to resolve any complaint at first contact. Please call us on 0203 488 1889 or email info@becoolrefrigeration.co.uk within 7 days of the issue arising. Complaints in writing should be sent to our registered office by recorded delivery.
14. Personal data
Our handling of your personal data is set out in our Privacy policy.
15. Governing law
These terms and any non-contractual obligations arising under them are governed by English and Welsh law. Any dispute falls within the exclusive jurisdiction of the English and Welsh courts. Nothing prevents you, where you are a consumer, from bringing proceedings in your country of residence as required by applicable law.
16. Changes
We may update these terms. The version that applies to your order is the one in force at the time you placed it (the “last updated” date shows the current version). Material changes will be communicated by email where we hold one.
